1. Information About Us

Planet Tracker, is an initiative of Tracker Group Limited and is a non-profit financial think tank. It was launched in 2018 by its founders, Mark Campanale and Nick Robins, who also created the Carbon Tracker Initiative.

Tracker Group is a not-for profit company limited by guarantee and registered in England with company number 08906960, with registered address at The Conduit, 6 Langley Street, London WC2H 9JA United Kingdom.  Tracker Group is the data controller under Privacy Law (see the General Data Protection Regulation). 2. Links To Other Websites

This Privacy Notice only applies only to your use of Tracker Group websites. Our Sites may contain links to other websites that are operated by other organisations. Please note that we have no control over how your data is collected, stored, or used by other websites and we advise you to check the privacy policies or notices of any such websites before providing any personal data to them.

3. What is Personal Data?

Personal data is defined by the UK General Data Protection Regulation (the “UK GDPR”) as ‘any information relating to an identifiable person who can be directly or indirectly identified in particular by reference to an identifier’.

Personal data is, in simpler terms, any information about you that enables you to be identified. Personal data covers obvious information such as your name and contact details, but it also covers less obvious information such as identification numbers, electronic location data, and other online identifiers. Personal data does not include information where the identity of the individual has been fully and effectively removed (anonymous data).

Under data protection legislation, certain personal data is considered more ‘sensitive’ (e.g., information relating to race, religion, political affiliation and health). This is also known as ‘special category data’. We do not typically collect special category data.

4. What Data Do We Collect?

Depending upon your use of our Sites, we may collect some or all of the following personal data (please also see Part 12 on our use of cookies and similar technologies. We collect the following information from you when you sign up for an account with us:

  • Username
  • First name
  • Last name
  • Company
  • Position
  • Email address
  • Password
  • Mobile number

We collect the following information from you automatically when you visit one of our Sites and accept cookies:

  • IP address (automatically collected);
  • Web browser type and version (automatically collected);
  • Operating system (automatically collected);
  • a list of URLs starting with a referring site, your activity on our Site, and the site you exit to (automatically collected);

We do this for system administration purposes, including to analyse trends and gather broad demographic information for aggregate use so that we can improve the relevant Site, and deliver customized, personalized content.

5. How Do We Use Your Personal Data?

Your personal data may be used for one of the following purposes:

  • Providing and managing your account;
  • Providing and managing your access to our Sites;
  • Personalising and tailoring your experience on our Sites;
  • Personalising and tailoring our services for you;
  • Communicating with you. This may include responding to emails from you;
  • Supplying you with information by email that you have opted-in to (you may unsubscribe or opt-out at any time by emailing us using the contact details set out in Part 14 below, or by following the instructions in any emails you receive from us);
  • Analysing your use of our Sites and gathering feedback to enable us to continually improve our Sites and your user experience.

With your permission and/or where permitted by law, we may also use your personal data for our newsletter, which may include contacting you by email with information on our research. You will not be sent any unlawful marketing or spam. We will always work to fully protect your rights and comply with our obligations under data protection law, and you will always have the opportunity to opt-out of receiving any communications from us by emailing us or by following the instructions in any emails you receive from us.

6. Our Lawful Bases

We must always have a lawful basis (i.e. a reason under the law) for using personal data. Most commonly, we will use your personal data for the following reasons:

  • Where it is necessary for our performance of a contract with you;
  • Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests. For example, we have a legitimate interest in providing our services to you;
  • Where we have your consent to do so, for example if you sign up to receive our newsletter. As noted above, you can withdraw your consent at any time by emailing us using the contact details in Part 14 below, or by following the instructions in any emails you receive from us;
  • Where it is necessary to comply with a legal obligation on us (for example, reporting to HM Revenue and Customs or Companies House).

7. How Long Will We Keep Your Personal Data

We will not keep your personal data for any longer than is necessary in light of the reason(s) for which it was first collected or until you notify us that you no longer wish to receive our information.

The criteria we use to determine the retention period of personal information are: (i) the respective statutory retention period; (ii) our contractual and/or business relationships with you; (iii) (potential) disputes; and (iv) any guidelines issued by relevant regulators. After expiration of the applicable retention period, the relevant information is routinely deleted, as long as it is no longer necessary for the fulfillment of a contract, the initiation of a contract or to protect or defend our position or that of a third party. 8. How and Where Do We Store or Transfer Your Personal Data?a

We currently only store or transfer your personal data within the UK. If we do transfer your personal data outside of the UK in the future, we will take steps to ensure that your personal data is protected in accordance with appropriate safeguards, especially where the recipient country is not considered to be adequate by the UK Government. In particular, we will rely on the appropriate safeguards under data protection legislation, such as standard contractual clauses (or equivalent) approved by the UK Government to protect your personal information.

9. How We Share Your Personal Data

We may share your personal information with third parties, including the following:

  • with contractors, suppliers, or other third parties that provide services on our behalf (such as website host providers);
  • as part of a sale, merger, restructuring or acquisition, or other transfer of all or part of our assets including as part of a bankruptcy proceeding;
  • pursuant to a subpoena, court order, or other legal process or as otherwise required or requested by law, regulation, or government authority programs, or to protect our rights or the rights or safety of third parties;
  • with our professional advisors, lawyers, accountants and auditors; or

10. Your Rights

Under the UK GDPR, you have the following rights, which we will always work to uphold:

  • The right to access the personal data we hold about you.
  • The right to have your personal data rectified if any of your personal data held by us is inaccurate or incomplete.
  • The right to be forgotten, i.e. the right to ask us to delete or otherwise dispose of any of your personal data that we have, in certain circumstances.
  • The right to restrict (i.e. prevent) the processing of your personal data.
  • The right to object to us using your personal data for a particular purpose or purposes, in certain circumstances.
  • The right to data portability. This means that, if you have provided personal data to us directly, we are using it with your consent or for the performance of a contract, and that data is processed using automated means, you can ask us to port that personal data to you or another third party so that it can be re-used with another service or business.
  • The right to withdraw your consent to us processing your personal data, where we are relying on that consent.
  • Rights relating to automated decision-making and profiling. We do not use your personal data in this way.

11. Withholding Information

You may access certain areas of our Sites without providing any personal data at all. However, to use all features and functions available on our Sites (such as downloading documents) you may be required to submit or allow for the collection of certain data.
